Definitions

Data Controller – the entity that determines why and how Personal Data is processed. ModusBrain is the Data Controller for account and usage data we collect directly from you.
Data Processor – processes data on behalf of a Data Controller. When you use ModusBrain to manage your organization's operational knowledge, ModusBrain acts as a Data Processor for the Workspace Data your organization controls.
User – any individual who accesses or uses the Service, whether as a workspace administrator, team member, or visitor.
Information We Collect
We collect the following categories of information to operate and improve the Service:
1. Account Information: When you sign up for ModusBrain, we collect information such as your name, email address, company or organization name, job title, and any other details you provide. This is used to create and manage your account, communicate with you, and deliver the Service.
2. Workspace and Operational Data: ModusBrain is designed to store, organize, and automate your organization's operational knowledge. This means you may input business processes, standard operating procedures (SOPs), team knowledge, workflow configurations, integrations, and related operational content into the platform. This Workspace Data belongs to you and your organization — we process it solely to provide the Service to you and never use it for our own commercial purposes. In self-hosted deployments, we do not have access to your Workspace Data at all; it remains on your own infrastructure.
3. Usage Data: We automatically collect technical information about how you use the Service. This may include your IP address, browser type and version, device type, operating system, pages or features accessed, time spent, error logs, and interaction events. We use this data to ensure platform stability, improve performance, and understand how our features are being used.
4. Cookies and Session Data: We use essential cookies to maintain your login session and remember your preferences. We do not use advertising cookies, third-party tracking pixels, or behavioral profiling tools. We may use privacy-respecting analytics (such as aggregate infrastructure metrics via our CDN) that do not identify individuals.

When you connect an integration, we receive only the data that you authorize that service to share, and we use it solely to power the integration you have configured.

Process Payments: Handle your subscription billing securely through our third-party payment processor. We do not store full payment card details.
Ensure Security and Compliance: Detect and prevent unauthorized access, fraud, abuse, or other violations of our Terms of Service. Monitor for and respond to security incidents.
Improve and Develop the Platform: Analyze aggregate usage patterns to understand which features work well, identify areas for improvement, and guide our product development decisions.

Your Organization: If you use ModusBrain as part of a team or organization, your account information and workspace activity may be visible to workspace administrators within your organization, consistent with the role-based permissions you and your admin have configured.
Integrations You Authorize: When you connect ModusBrain to a third-party integration, we share the data necessary to power that integration, but only with your explicit authorization and direction.
Business Transactions: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction. We will notify you before your data is transferred to a different privacy policy.
Legal Requirements: We may disclose your information when required to do so by law, court order, or lawful government request, and only to the extent required.

Usage Data: Aggregate and technical usage data may be retained for a shorter period and used only for platform analysis and improvement.
Backup Data: If deletion of data in backups is technically infeasible immediately, we will isolate the data from further use until deletion is complete.

ModusBrain is headquartered in the United States, and our primary cloud infrastructure is hosted in the European Union (Frankfurt, Germany). We plan to expand to additional regions in 2026 to support local data residency requirements.
For Personal Data originating from the EEA, UK, or Switzerland, we ensure that any cross-border transfers are protected by appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission. No transfer of your Personal Data will occur to a country or organization without adequate data protection controls in place.
Children's Privacy
ModusBrain is not intended for individuals under the age of 18. We do not knowingly collect Personal Data from minors. If you believe a minor has provided us with their information, please contact us immediately and we will delete it promptly.
